Το SolidarityNow στη συνάντηση της Επιτροπής για τις ατομικές ελευθερίες & τη Δικαιοσύνη του Ευρωπαϊκού Κοινοβουλίου με εκπροσώπους της Κοινωνίας των Πολιτών


Στις 2 Νοεμβρίου στα γραφεία της Ευρωπαϊκής Επιτροπής στην Αθήνα, η Επιτροπή για τις ατομικές ελευθερίες  και τη Δικαιοσύνη του Ευρωπαϊκού Κοινοβουλίου (Committee on Civil Liberties, Justice and Home Affairs-LIBE), οργάνωσε μια συνάντηση με εκπροσώπους της Κοινωνίας των Πολιτών που δουλεύουν στο πεδίο προστασίας των προσφύγων.

Στη συνάντηση συζητήθηκε, μεταξύ άλλων, το ζήτημα των παράνομων επαναπροωθήσεων (pushbacks), για το οποίο τόσος θόρυβος έχει ξεσπάσει σε εθνικό και ευρωπαϊκό επίπεδο, καθώς και μια πρώτη αποτίμηση για τις συνθήκες στα νέα κέντρα κράτησης που εγκαινιάστηκαν πρόσφατα.

Στη συνάντηση ήταν παρούσες οι πιο γνωστές ΜΚΟ που δραστηριοποιούνται στο πεδίο. Το SolidarityNow εκπροσωπήθηκε από τη δικηγόρο Μαρίνα Κάντα, Συντονίστρια της Νομικής Υπηρεσίας στο Κέντρο Αλληλεγγύης της Αθήνας*. Η Μαρίνα, στην ολιγόλεπτη αλλά μεστή παρέμβασή της, αφού παρουσίασε το σημαντικό έργο του SolidarityNow τα τελευταία χρόνια, εστίασε στο μεγάλο ζήτημα της έλλειψης πολιτικών ένταξης για τους μεταναστευτικούς πληθυσμούς. Όσον αφορά τις συνθήκες στα νέου τύπου κέντρα κράτησης αλλά και τις παράνομες επαναπροωθήσεις, η Μαρίνα τόνισε ότι το σημαντικό πρόβλημα είναι αφενός η εξαρχής υπονόμευση κάθε μελλοντικής πολιτικής ένταξης, όταν οι τοπικές κοινωνίες υποδοχής «επιβάλλουν» την αρχιτεκτονική και την αισθητική των κέντρων ελεγχόμενης προσωρινής διαβίωσης, ενώ ως προς τις παράνομες επαναπροωθήσεις, κάλεσε την ομάδα των Ευρωβουλευτών να εστιάσουν και στη συνθήκη «θεσμοθετημένων πλέον επαναπροωθήσεων» που είναι το αποτέλεσμα της πρόσφατης ΚΥΑ που ορίζει ότι η Τουρκία αποτελεί ασφαλή τρίτη χώρα για αιτούντες άσυλο, που προέρχονται από τη Συρία, το Πακιστάν, το Μπαγκλαντές, το Αφγανιστάν και τη Σομαλία. Πλέον, για την πλειοψηφία των αιτούντων που προέρχονται από τις προαναφερόμενες χώρες καταγωγής, το αίτημά τους για διεθνή προστασία στην Ελλάδα απορρίπτεται ως απαράδεκτο χωρίς να εξετάζεται η υπόθεσή τους στην ουσία, αφού διατάσσεται η επανεισδοχή τους στην Τουρκία. Πρόκειται για μια σύγχρονη θεσμική εκδοχή της λεγόμενης externalization of migration και αποτρεπτικού ελέγχου των ροών.

Η έκπληξη των Ευρωβουλευτών ήταν μεγάλη,  όταν μισή περίπου ώρα μετά τη σημαντική αυτή σύσκεψη, σε προγραμματισμένη επίσκεψη αυτοψίας στην Αστυνομική Διεύθυνση Αλλοδαπών της Πέτρου Ράλλη, συνάντησαν και πάλι τη Μαρίνα Κάντα που νωρίτερα τους είχε αναλύσει τα σημαντικά προβλήματα από τις διαδικασίες ασύλου στην Ελλάδα. Αυτή τη φορά την είδαν επί το έργον, στους γκρίζους διαδρόμους της Διεύθυνσης Αλλοδαπών, να υποστηρίζει μια οικογένεια Νιγηριανών στην προσπάθειά τους να εκδώσουν νομιμοποιητικά έγγραφα για το νεογέννητο παιδί τους.

Στο SolidarityNow εδώ και χρόνια γίνεται μια μεθοδική δουλειά βάσης, που επιτρέπει στα στελέχη μας να είναι παρόντα τόσο στις διεργασίες της απλής αλλά σκληρής καθημερινότητας όσο και στο επίπεδο της λήψης αποφάσεων, σε εθνικό και ευρωπαϊκό επίπεδο. Με την  εμπειρία της ενσυναίσθησης, της γνώσης, για την Αλληλεγγύη που είναι ο στόχος μας.

World Mental Health Day, 10/10/2021: “Mental Health in an Uneven World”

This year’s celebration of the World Mental Health Day is more important than ever. After a year and a half of humanity’s war against the coronavirus, we no longer doubt the importance of mental health, both individually and socially.

During the pandemic, we recall news related to the increase of psychotropic drug use and the reports on the increased number of suicides. At the same time, if one searches for online data related to the use of psychotropic drugs in Greece or the number of suicides -successful or not- or even if one observed the rise of anxiety disorder incidents and mood disorders (e.g., depression), he would find very few reports and studies processing this data. We believe that we need to seriously address the insufficient attention to mental health issues. And even more today, after a year and a half of struggle with the pandemic.

One of the worldwide serious effects of the COVID-19 outbreak is that it brought to light existing inequalities due to race and ethnicity, economic status, sexual orientation, and gender identity, as well as due to mental health problems. This exacerbation can only give birth to and foster a negative impact on people’s mental health. Unfortunately, one of the key inequalities is access to mental health services.

Nonetheless, access to mental health services offers countless benefits to the society. They initially contribute to the improvement of the people’s overall health, then to the indiscriminate integration of everyone and last but not least to the minimization of social discord and upheaval.

That’s why our work inspires us. The Psychological Support-Counseling Service of the Athens Solidarity Center by SolidarityNow is a service open to all those who need it. We are proud that so many people trust us and give us the opportunity to stand by their side. We believe that today, above all, we must embrace diversity and show that apparent weakness is a disguised strength. And we will make it through our greatest weapon, Solidarity.

Την Πέμπτη 23 Σεπτεμβρίου 2021, το Συμβούλιο Ένταξης Μεταναστών και Προσφύγων (ΣΕΜΠ) του Δήμου Θεσσαλονίκης και η Ομάδα Εργασίας για την εργασιακή ένταξη μεταναστών και προσφύγων, διοργανώνουν την ημέρα καριέρας Career4all στο προαύλιο του Δημαρχείου Θεσσαλονίκης, με κεντρικό σκοπό τη διασύνδεση του προσφυγικού πληθυσμού με την αγορά εργασίας.

Οι  δράσεις της εκδήλωσης, στις οποίες θα υπάρχει παράλληλη διερμηνεία στα αγγλικά, αραβικά, γαλλικά, φαρσί και ουρντού, απευθύνονται κυρίως σε πρόσφυγες και αιτούντες άσυλο, οι οποίοι αναζητούν εργασία στην περιοχή της Θεσσαλονίκης.

Κατά τη διάρκεια της εκδήλωσης, εξειδικευμένοι σύμβουλοι σταδιοδρομίας θα ενημερώσουν τους υποψηφίους σχετικά με πρακτικά ζητήματα που αφορούν στην πρόσβαση στην τοπική αγορά εργασίας, ενώ εκπρόσωποι επιχειρήσεων θα παρουσιάσουν τη φύση των εργασιών τους και τις δεξιότητες που απαιτούνται στους κλάδους που εκπροσωπούν.

Στο πλαίσιο της εκδήλωσης, πρόσφυγες θα μοιραστούν τη δική τους εμπειρία εργασίας στην Ελλάδα με άλλους υποψήφιους εργαζομένους.

Επιπλέον, θα υλοποιηθεί ειδική συνεδρία για επιχειρήσεις με στόχο την πληροφόρησή τους για τα εργασιακά δικαιώματα των προσφύγων στην Ελλάδα και για θέματα ισότητας ευκαιριών και διαφορετικότητας στην αγορά εργασίας.

Διεκδικώντας μία θέση εργασίας

Παράλληλα με τις προαναφερόμενες δράσεις, θα παρευρίσκονται εκπρόσωποι εταιρειών, με τους οποίους μπορούν να έρθουν σε επαφή πρόσφυγες που αναζητούν εργασία και επιθυμούν να απασχοληθούν στις προσφερόμενες από τις εταιρείες θέσεις.

Λίγα λόγια για τους διοργανωτές

Η ημέρα καριέρας Career4all αποτελεί μια πρωτοβουλία της “Ομάδας Εργασίας για την υποστήριξη στην εργασιακή ένταξη μεταναστών και προσφύγων” σε συνεργασία με το Συμβούλιο Ένταξης Μεταναστών και Προσφύγων του Δήμου Θεσσαλονίκης.

Η ομάδα εργασίας αποτελεί σημείο συνάντησης τοπικών και διεθνών οργανώσεων και οργανισμών οι οποίοι δραστηριοποιούνται σε υπηρεσίες συναφείς με την απασχολησιμότητα και την εργασιακή ένταξη. Στόχος της είναι η διασύνδεση των φορέων και των οργανώσεων, η ενημέρωση για τρέχοντα ζητήματα και η διοργάνωση δράσεων για την αντιμετώπιση των προκλήσεων που αφορούν την κοινωνική και εργασιακή ένταξη του μεταναστευτικού και προσφυγικού πληθυσμού της πόλης.

Φορείς και προγράμματα που συμμετέχουν: Δήμος Θεσσαλονίκης, Δήμος Νεάπολης-Συκεών, ΙΝΕ ΓΣΕΕ, EU funded HELIOS Project – ΔΟΜ, Ύπατη Αρμοστεία του ΟΗΕ για τους Πρόσφυγες, ΑΡΣΙΣ – Κοινωνική Οργάνωση Υποστήριξης Νέων, ActionAid Hellas, IsraAID, ΝΑΟΜΙ – Οικουμενικό Εργαστήριο Προσφύγων και SolidarityNow.

Αρμοδιότητες του ΣΕΜΠ, είναι μεταξύ άλλων η καταγραφή και η διερεύνηση προβλημάτων που αντιμετωπίζουν οι μετανάστες και οι πρόσφυγες που κατοικούν μόνιμα στην περιφέρεια του Δήμου Θεσσαλονίκης, ως προς την ένταξή τους στην τοπική κοινωνία, η επαφή τους με δημόσιες αρχές ή τη δημοτική αρχή και η υποβολή εισηγήσεων προς το δημοτικό συμβούλιο για την ανάπτυξη τοπικών δράσεων προώθησης της ομαλής κοινωνικής ένταξης των μεταναστών και προσφύγων.

One year after the Moria fire: Few lessons learned as Greece expands barriers to refugees’ protection

One year after the Moria fire that left 13.000 people homeless,

45 NGOs and civil society groups have today released a report urging the European Union and Greek government to abandon plans to dramatically restrict the movement of people in refugee camps in Greece. With financial and technical support from the European Commission, authorities in Greece are constructing fences and concrete walls around dozens of existing camps and building closed camps in remote locations on the Aegean islands. New legislation aims to further restrict the freedom of movement of camp residents and access for NGOs, journalists, and others with critical aid delivery and monitoring roles.

When a devastating fire destroyed Moria camp on the Greek island of Lesvos burned to the ground on the night of 8-9 September 2020, Greek and European officials promised they would improve reception conditions. EU Commissioner for Home Affairs Ylva Johansson said there should be “no more Morias.” Yet, rather than pursuing alternatives to camps, the EU and Greece have hardened their approach. As the report shows, authorities are pursuing “harmful policies focused on deterring and containing asylum seekers and refugees,” thus “jointly implementing and deepening the status quo.”

Within months of the fire in September 2020, Greek and EU officials agreed to the construction of Multi-Purpose Reception and Identification Centres (MPRICs) on five Aegean islands. On the mainland, they began building walls and chain link fencing around dozens of existing camps. Camp residents and NGOs familiar with the plans have likened these facilities to prisons.

The report identifies a number of significant concerns about the plans, warning that the new structures “will impede effective identification and protection of vulnerable people; limit access to services and assistance for asylum seekers; hinder independent monitoring of conditions inside facilities; and exacerbate the harmful effects of displacement and containment on individuals’ mental health. Moreover, these policies will preclude displaced people’s integration in local communities, to their detriment and that of Greece.”

The European Commission is funding the construction projects with grants exceeding €250 million. Commissioner Johansson has defended the work, insisting that the new structures on the islands will not be closed and that people will be free to come and go. Yet the Greek authorities make no secret of their intention to restrict freedom of movement for camp residents: on 29 March 2021, the Greek Minister of Migration and Asylum, Notis Mitarachi, described the new MPRICs as “closed and controlled.” He has used similar language when discussing camp facilities.

Questioning how and why EU funds are being used to restrict the freedom of movement of people seeking sanctuary, the report urges Members of the European Parliament (MEPs) to urgently investigate the current construction process and intervene to protect the rights and liberties of people seeking asylum in Greece. In a list of recommendations, the report asks EU institutions and national governments, particularly the Greek authorities, the European Commission and its Task Force Migration Management, and Members of the European Parliament to:

  1. Guarantee that new arrivals to the Greek island are not detained in MPRICs by default and that restrictions on movement are based on an individual assessment and do not exceed limitations laid down in law.
  2. Secure a firm commitment from the Greek authorities that the freedom of movement of residents of all camps will be upheld, and that access to essential services, including education (especially for children), and healthcare is guaranteed.
  3. Guarantee that asylum seekers located at facilities in remote areas have access to city centres or nearby urban areas by facilitating transport and opportunities for engagement, thereby preventing the harmful effects of isolation and social exclusion and promoting an early start to integration.
  4. Urgently scrutinising the use of EU funds to finance the construction of MPRICs and walls around mainland camps, and considering a moratorium on construction until the fundamental rights of residents are guaranteed.
  5. Guarantee a timely and adequate monitoring and evaluation plan to assess conditions in the new MPRICs and walled-off camps and their impact on residents’ access to rights, material reception conditions, services, assistance, mental health, and education  (especially for children).
  6. Ensure that legislation governing NGOs’ access to reception facilities in Greece is in line with EU and international law and standards regarding the freedom of association and does not hinder the provision of adequate services and support to asylum seekers living inside reception facilities. The EU Commission should proceed without delay in assessing whether Greek legislation restricting NGO activity is compatible with EU law.
  7. Urge the Greek government to revoke the new restrictions on cash assistance to allow asylum seekers to live in independent housing, and investing in alternative accommodation to reception facilities to promote integration and social inclusion while people complete the asylum process.
  8. Urge the Greek government to introduce protocols for the operation and monitoring of all reception facilities that ensure adequate security and protection of camp residents and staff without encroaching on their rights and freedoms.

Η πτώση της Καμπούλ και η επικράτηση των Ταλιμπάν έχουν μια πολύ άμεση συνέπεια: πολλοί άνθρωποι στο Αφγανιστάν βρίσκονται ήδη σε κίνδυνο.

Σαφώς δεν είμαστε σε θέση να προβλέψουμε αν θα υπάρξουν προσφυγικές ροές από το Αφγανιστάν, αν και αυτό φαντάζει πιθανό. Η εμπειρία από το προηγούμενο καθεστώς των Ταλιμπάν και οι πρόσφατες αγριότητες υποδεικνύουν πως η ζωή και η ελευθερία πολλών χιλιάδων αμάχων και ιδιαίτερα γυναικών βρίσκεται σε κίνδυνο λόγω των θρησκευτικών πεποιθήσεών τους, της εθνοτικής καταγωγής τους, του φύλου και του σεξουαλικού προσανατολισμού τους ή των πολιτικών τους πεποιθήσεων.

Αυτή η συγκυρία θα πρέπει να σημάνει συναγερμό για κάθε δημοκρατική κοινωνία. Συναγερμό για την ανάγκη προστασίας ανθρώπων σε κίνδυνο, για την ανάγκη να σωθούν ανθρώπινες ζωές.

Με βαθιά λύπη διαπιστώνουμε πως η έως τώρα πολιτική πραγματικότητα απέχει από αυτό το σκοπό. Πως υπάρχει μια έκτακτη κινητοποίηση μεταξύ των κρατών μελών της ΕΕ, αλλά προς τον αντίθετο σκοπό. Πως εκεί όπου θα έπρεπε να υπάρχει κινητοποίηση αλληλεγγύης, μοιάζει να υπάρχει μόνο προετοιμασία για αποτροπή.

Στη χαραυγή εξελίξεων που μπορεί να οδηγήσουν σε μια νέα, παρατεταμένη ανθρωπιστική κρίση και που κάθε δυνατή προσπάθεια θα πρέπει να επικεντρωθεί στην προστασία της ζωής όσων έχουν ανάγκη, μοιάζει αδιανόητο να ανακοινώνεται πως η Ελλάδα δεν μπορεί να γίνει «πύλη εισόδου για ένα νέο κύμα προσφύγων».

Είναι επίσης αδιανόητο το πώς ακόμα και πέντε μέρες πριν την πτώση της Καμπούλ, 6 υπουργοί χωρών της ΕΕ (συμπεριλαμβανομένης της Ελλάδος) προέτρεψαν την Ευρωπαϊκή Επιτροπή να εντείνει τις συζητήσεις της με την (πάλαι ποτέ) κυβέρνηση του Αφγανιστάν, ώστε να διασφαλιστεί πως οι αναγκαστικές απελάσεις Αφγανών πολιτών προς το Αφγανιστάν θα συνεχιστούν.

Ως μέλη της κοινωνίας των πολιτών, νιώθουμε την ευθύνη να επισημάνουμε πως κάθε άνθρωπος που βρίσκεται σε κίνδυνο δίωξης για λόγους καταγωγής και συνείδησης έχει το δικαίωμα να προστατευτεί με βάσει το διεθνές δίκαιο προστασίας των προσφύγων. Νιώθουμε το χρέος να επισημάνουμε πως κάθε άτομο που αναζητά άσυλο έχει δικαίωμα το αίτημά του να εξετασθεί ατομικά, όπως προβλέπεται από τις αρχές του διεθνούς και ενωσιακού δικαίου.

Σε αυτό το πλαίσιο, μας ανησυχεί ιδιαίτερα το γεγονός ότι στη χώρα μας, οι έως τώρα προετοιμασίες για τη διαχείριση των δυνάμει επακόλουθων της κρίσης στο Αφγανιστάν, φαίνεται να επικεντρώνονται μόνο στην ενίσχυση των μηχανισμών αποτροπής. Μας ανησυχεί επίσης πολύ το ενδεχόμενο άνθρωποι σε ανάγκη να αποτραπούν από το να βρουν ασφαλές καταφύγιο για τους ίδιους και τις οικογένειές τους και καλούμε την ελληνική κυβέρνηση να αποφύγει ένα τέτοιο ενδεχόμενο με κάθε τρόπο.

Οι τραγικές εξελίξεις στο Αφγανιστάν κάνουν επιτακτική την ανάγκη να επανεξεταστούν πρόσφατες αποφάσεις απόρριψης ασύλου πολιτών του Αφγανιστάν και το θεσμικό πλαίσιο που τις διέπει. Όπως είναι γνωστό, η Τουρκία πρόσφατα ανακηρύχθηκε σε «ασφαλή τρίτη χώρα» για τους πολίτες του Αφγανιστάν. Η εφαρμογή αυτού του μέτρου μπορεί να οδηγήσει στην άρνηση της ελληνικής Πολιτείας να εξετάσει την ουσία αιτημάτων ασύλου πολιτών του Αφγανιστάν. Από μόνο του αυτό είναι απαράδεκτο, καθώς ισοδυναμεί με την άρνηση της ευθύνης προστασίας ατόμων προερχόμενων από την λιγότερο ασφαλή χώρα του κόσμου. Εν όψει και της συνεχιζόμενης άρνησης της Τουρκίας, ήδη από τον Μάρτιο του 2020, να δεχθεί την επιστροφή πολιτών τρίτων χωρών από την Ελλάδα, αυτό θα οδηγήσει έναν σημαντικό αριθμό Αφγανών αιτούντων άσυλο σε ένα ανεπίτρεπτο νομικό κενό μεταξύ Ελλάδας και Τουρκίας, σε μια κατάσταση χωρίς πρόσβαση στη υγεία, χωρίς πρόσβαση στη στέγη και χωρίς πρόσβαση στην εκπαίδευση. Καλούμε, λοιπόν, για μια ακόμη φορά την ελληνική κυβέρνηση να αναθεωρήσει την πρόσφατη Κοινή Υπουργική Απόφαση σε σχέση με τους πολίτες Αφγανιστάν.

Οι κυβερνήσεις της ΕΕ δεν θα πρέπει να αρνηθούν, μέσω της ανάθεσης των ευθυνών τους σε τρίτες χώρες, να συνδράμουν καθοριστικά στον επιμερισμό της ευθύνης προστασίας όσων Αφγανών πολιτών αναζητήσουν διεθνή προστασία. Αυτή η ευθύνη αλληλεγγύης πηγάζει από τις δημοκρατικές, ιστορικές και πολιτισμικές αρχές των χωρών της ΕΕ, όπως και το διεθνές δίκαιο. Ας μην αποτύχουμε για μια ακόμη φορά να προασπισθούμε τις αρχές της δημοκρατίας, του ανθρωπισμού, του κράτους δικαίου και της αλληλεγγύης.

Completion of the organization’s intervention supporting unaccompanied refugee children, in three transitional accommodation structures in northern Greece.

From September 2020 until June 2021, SolidarityNow provided care and support to 212 unaccompanied children, under the framework of the EU “Voluntary relocation scheme from Greece to other European Countries”. The action was implemented under the general coordination of the Government of Greece, the Ministry of Migration and Asylum, through the Special Secretary for the Protection of Unaccompanied Minors, in partnership with the International Organization for Migration (IOM) and the support of the European Commission.

The goal of the intervention was the safe and organized transfer of children from the northern Aegean islands and the Evros border region to the mainland prior to their relocation to other European countries.

SolidarityNow’s experienced and specialized staff, focusing on the safety, protection and empowerment of children, provided -among other services- psychosocial support, legal support and representation, non-formal education and leisure activities, advice on medical issues and escorts to health facilities. The children embraced the informal education and recreational activities with great enthusiasm, helping them to learn, make friends, and smile again.

Furthermore, the local communities in the prefectures of Kozani and Ioannina where the transitional accommodation structures were located, embraced the action, and the residents contributed to its smooth development and completion. Through the video created by the organization’s staff, the children talk about how their lives changed with this intervention, while members of the local community of Velvento, Kozani share their views from their interactions with the children.  Event for the completion of the second grant period of EEA Grants at the Athens Solidarity Center

On the occasion of the completion of the second grant period for the operation of the Athens Solidarity Center* by the financial mechanism EEA Grants, SolidarityNow organizes an online event and a premiere, on Tuesday, June 29 at 16.00.

The financial support by the EEA Grants entitled “Increased opportunities for integration and social inclusion for vulnerable individuals”** started in May 2019 and will end next month. The Athens Solidarity Center was supported to continue to provide cohesive social welfare services to all and over the two years has achieved significant results supporting people in need.

The challenge of the period was the Center’s response to the emergency conditions created by the Covid-19 pandemic. Beside the pandemic, the Athens Solidarity Center succeeded in providing support to more than 6,500 people. The total number of services offered exceeds 24,600.

Official release of the documentary “Common People, Common Ground”

On Tuesday, June 29 at 16.00, SolidarityNow will present for the first time the work carried out at the Athens Solidarity Center through the documentary “Common People, Common Ground”, a production of the Norwegian Embassy in Athens. Director Theodore Scrivanos will make a brief introduction to the world of his film, using the realistic depiction of the accomplished work and the beneficiaries’ human stories and testimonies.

The event will be addressed by the Ambassador of Norway to Greece, Mr. Frode Overland Andersen, Mr. Epaminondas Farmakis, Co-founder and General Manager HumanRights360, Director of the “Local Development and Poverty Reduction” and “Asylum and Migration” programs in Greece, EEA Grants, 2014–2021 and Mr. Stelios Zavvos, Chairman of the SolidarityNow Board of Directors.

ΚΟΙΝΟ ΔΕΛΤΙΟ ΤΥΠΟΥ: Ένα μεγάλο πισωγύρισμα στην ένταξη, η περικοπή του βοηθήματος σε αιτούντες άσυλο


Με ανακοίνωσή του στις 15 Απριλίου, το Υπουργείο Μετανάστευσης και Ασύλου εξήγγειλε την οριζόντια περικοπή του οικονομικού βοηθήματος για όλες και όλους τους αιτούντες άσυλο που δεν στεγάζονται σε δομές της ευθύνης του ή των συνεργαζόμενων με αυτό φορέων, από την 1η Ιουλίου 2021. Η εξαγγελία αυτή έγινε, μάλιστα, χωρίς την έκδοση καμίας σχετικής Υπουργικής Απόφασης που να εξειδικεύει τη διαδικασία.

Σύμφωνα με την ανακοίνωση: «Οι αιτούντες που συγκαταλέγονται στον αστικό πληθυσμό, εφόσον δεν έχουν τους απαραίτητους πόρους για να καλύψουν τις βασικές ανάγκες διαβίωσής τους, θα πρέπει να υποβάλλουν αίτημα στέγασης στους αρμόδιους φορείς».

Καθώς η διορία πλησιάζει, οι οργανώσεις μας επισημαίνουν πως η συγκεκριμένη απόφαση έχει σοβαρές  προβληματικές πλευρές, τόσο κοινωνικές όσο και νομικές.

Υπολογίζεται πως έως και 25.000 αιτούντες άσυλο, μεταξύ των οποίων και πολλές οικογένειες με παιδιά, έχουν καταφέρει να αυτοστεγαστούν, χάρη στο οικονομικό βοήθημα που τους παρέχεται στο πλαίσιο των συνθηκών υποδοχής, με ευρωπαϊκούς πόρους. Είναι άνθρωποι που κατάφεραν να συγκατοικήσουν με ανθρώπους της επιλογής τους: να νιώσουν ασφαλείς με φίλους, συντρόφους, συγκατοίκους, που τους υποστηρίζουν σε περίπτωση ανάγκης (ψυχικής ασθένειας, αναπηρίας, προχωρημένης ηλικίας κ.λπ.). Άνθρωποι που τα παιδιά τους πηγαίνουν στο σχολείο, που έχουν αποκτήσει φίλους, κοινωνικές σχέσεις και μια καθημερινότητα. Είναι, δηλαδή, άνθρωποι που με πολύ αγώνα έχουν κάνει βήματα για να ανακτήσουν την αυτονομία τους, γεγονός που ενισχύει και την προοπτική της ένταξης για όσους και όσες, τελικά, θα μείνουν στην Ελλάδα.

Τώρα όμως, καλούνται να εγκαταλείψουν την όποια ζωή κατάφεραν να δημιουργήσουν, να εγκατασταθούν σε διαμερίσματα με πολλούς άλλους συγκατοίκους που δεν γνωρίζουν και συχνά από άλλες εθνικότητες.  Καλούνται επίσης να επιστρέψουν σε δομές καταυλισμών εκτός του αστικού ιστού, συχνά πίσω από υπερυψωμένα τείχη, με προφανείς δυσμενείς συνέπειες για την αξιοπρέπεια και την προοπτική της ένταξής τους. Και όλα αυτά, για να μεταφερθούν σε μια κατοικία ελεγχόμενης διαμονής, χωρίς να είναι σαφές το πώς θα επιτευχθεί αυτό ομαλά στην πράξη και χωρίς καν το Υπουργείο να διαθέτει την απαραίτητη υποδομή για να υλοποιήσει την απόφαση.

Στην ανακοίνωση του Υπουργείου, δεν υπάρχει καμία πρόβλεψη για το πώς θα διασφαλιστεί η έγκαιρη μεταφορά των ανθρώπων σε απομακρυσμένες δομές ή διαμερίσματα ή για το εάν και με ποιον τρόπο θα καλύπτονται τα έξοδα της μετακίνησής τους, δεδομένου ότι πολλοί αδυνατούν να το κάνουν από μόνοι τους. Δεν υπάρχει καμία αναφορά για το εάν και πώς θα διασφαλίζεται από τις αρμόδιες υπηρεσίες η έγκαιρη μεταφορά της υπόθεσης ασύλου τους στο πλησιέστερο Γραφείο Ασύλου του νέου τόπου κατοικίας τους.

Το Υπουργείο ζητάει τη συνδρομή της κοινωνίας των πολιτών για την υλοποίηση αυτής της εξαγγελίας. Ζητάει, δηλαδή, από Μη Κυβερνητικές Οργανώσεις  να αναλάβουν εξολοκλήρου την εφαρμογή της απόφασής του: να καταγράψουν τα αιτήματα στέγασης, να ενημερώσουν τους αιτούντες, να διαχειριστούν όλο το φόβο, το θυμό και την απόγνωσή τους για τη ζωή που αναγκάζονται, για μια ακόμη φορά, να εγκαταλείψουν, έχοντας  μάλιστα ελάχιστη προθεσμία (μία-τρεις μέρες), για να αποφασίσουν αν αποδέχονται τη μετακίνησή τους.

Το μήνυμα που στέλνει το  Υπουργείο είναι ότι οι αιτούντες άσυλο πρέπει να ζουν μέσα σε κέντρα φιλοξενίας. Αυτό θα αποτελέσει μέγιστο πισωγύρισμα στη διαδικασία της ένταξης και θα δημιουργήσει συνθήκες γκέτο και περιθωριοποίησης.

Επίσης  η  απόφαση αυτή δεν συμβαδίζει με την ισχύουσα νομοθεσία.

Σύμφωνα με το άρθρο 57 του πρόσφατου νόμου 4636/2020, ο περιορισμός ή η διακοπή των υλικών συνθηκών υποδοχής, στις οποίες περιλαμβάνεται και το οικονομικό βοήθημα, αφενός απαιτεί ατομική και αιτιολογημένη κρίση από την αρμόδια αρχή υποδοχής, δηλαδή δεν είναι επιτρεπτή με μια οριζόντια και γενική απόφαση. Αφετέρου, επιτρέπεται μόνο όταν συντρέχουν οι όροι που προβλέπει η διάταξη του παραπάνω άρθρου 57, που επαναλαμβάνει τις σχετικές διατάξεις της ευρωπαϊκής Οδηγίας 2013/33/ΕΕ, δηλαδή μόνο όταν ο αιτών εγκαταλείπει το χώρο φιλοξενίας χωρίς να ενημερώσει την αρμόδια διοίκηση ή όταν δεν συμμορφώνονται με τις υποχρεώσεις δήλωσης στοιχείων ή σε περίπτωση μεταγενέστερου αιτήματος.

Σε αντίθεση προς αυτές τις περιοριστικά οριζόμενες προϋποθέσεις, η ανακοίνωση του Υπουργείου Μετανάστευσης και Ασύλου, χωρίς σαφές έρεισμα στο νόμο ,προαναγγέλλει την διακοπή του βοηθήματος για όλο τον αστικό πληθυσμό που δεν στεγάζεται στις δομές ευθύνης του Υπουργείου.

Με βάση τα παραπάνω, καλούμε το Υπουργείο να επανεξετάσει την απόφαση αυτή, και να μην επιβάλει ένα μέτρο το οποίο και εγείρει ζητήματα νομιμότητας, αλλά και, πάνω από όλα, θα οξύνει τα προβλήματα ένταξης των αιτούντων άσυλο στη χώρα μας.

Joint Press Release: Greece deems Turkey “safe”, but refugees are not.

The substantive examination of asylum applications is the only safe solution for refugees

With a new Joint Ministerial Decision (JMD) issued on 7 June,[1] the Greek State designates Turkey as a “safe third country” for families, men, women and children of five nationalities[2] seeking international protection in Greece. It is noted that the JMD applies even to those from countries with high recognition rates for international protection, such as Syria, Afghanistan and Somalia.[3] This decision reinforces the policy established by the March 2016 EU-Turkey Statement that shifts the responsibility to protect refugees, including unaccompanied children,[4] arriving in Europe to third countries.

For years, the effect of this externalisation policy has been to turn the Greek islands into a place of confinement for thousands of displaced and persecuted people, as authorities prioritised “containing” them on the islands to facilitate their return to third countries. This created places like Moria that became shameful symbols of Europe’s failure to protect refugees. But the solution is not to send displaced individuals to Turkey. In Turkey, people seeking asylum from non-European countries are not granted international protection per the 1951 Refugee Convention, while in March 2021 Turkey announced it would withdraw from the Istanbul Convention, and will thus not be protecting victims of gender-based violence, who are at an increased risk in case of return from Greece, based on the new JMD. People should not be returned to a country where their lives would be in danger, but multiple reports over recent years warn of the refoulement of refugees from Turkey, even to war zones in Syria.[5] Furthermore, the concept of a “safe third country” presupposes the existence of an essential connection between the asylum seeker and that country, as well as the consent of the third country to receive the returnee. These conditions are not met in the case of Turkey.

The decision to designate Turkey as a “safe third country”, should be revoked for the aforementioned reasons. Furthermore, the unworkability of this new law is highlighted, since as far back as March 2020, Turkey is not accepting the return of refugees and asylum seekers from Greece. This has been pointed out by Greece’s Ministry of Migration and Asylum as well as the European Commission.[6] Refugees whose applications have been rejected as inadmissible according to the “safe third country” principle, are already enduring a situation of protracted legal uncertainty, social exclusion, destitution, homelessness, and even prolonged detention in Greece, which is at risk of turning into a prison.[7] This JMD will serve only to increase the number of people in such a situation.

In fact, as has been pointed out in relevant interventions by the Greek Ombudsperson, and more recently in a reply by the Commissioner for Migration and Home Affairs of the European Commission,[8] in these cases applicants must be able to re-apply for asylum, and have their applications examined on their merits, in accordance with EU and national law.[9]

In line with a recent announcement by the UN High Commissioner for Refugees (UNHCR),[10] our organisations stress that “externalization simply shifts asylum responsibilities elsewhere and evades international obligations”. We once again call on the Greek and European authorities to honour their responsibility to protect refugees and to avoid further undermining the European asylum acquis and the fundamental principles and values for protecting human rights. To this end, we call on Greece to revoke the JMD issued on 7 June.
